Calcutta High Court grants interim stay on transfer of contract teachers

The Calcutta High Court on Wednesday heaved a sigh of relief while granting an interim stay on the transfers of contractual teachers of the Shishu Shiksha Kendra (SSK).
In the order given by Justice Sugata Bhattacharya, it has been said that the plaintiff teachers cannot be transferred till November 30.
The matter of transfer of contract teachers came into the limelight when five protesting teachers consumed poison in front of Vikas Bhawan, the headquarters of the state education department. One of them, a teacher from Balagarh in Hooghly district, was transferred to Ratua in Malda district of North Bengal.
A day after the transfer order was issued, teachers protesting under the banner of Shikshak Okya Manch (Teachers Ekta Manch) complained that the government was taking revenge on them as they demonstrated in front of the state headquarters in Nabanna on August 16.
Moidul Islam, a teacher and one of the leaders of the Teacher Okya Manch, fighting against the transfer of primary teachers, complained before the Calcutta High Court that a large number of police gathered in front of his house at Beliaghat in north Kolkata on Thursday and night Tried to forcibly take him to the police station.
The court hearing the matter said that there was no justifiable reason behind the transfer. Justice Bhattacharya, while hearing the matter on Tuesday, said that there is no rule of transfer. If there is no specific policy for transfer of contract teachers, on what basis did the state government transfer them? The court gave the state a day’s time to explain its position.
On Wednesday, the court wanted to know on what grounds the transfers were made, but the state government could not give a proper reply, so the court issued an interim stay order on the transfer of contractual teachers.
