Due to this the government system of sample testing of narcotics has started gasping. In the cases of NDPS Act, the number of samples being sent for investigation has doubled in the state in the last four years. Whereas only two laboratories are operating in the state for sample testing of narcotics.
Due to the increasing workload on the laboratory, barring special cases, it is taking more than several weeks for the investigation report to come. Due to this, there is a delay in starting the trial of the case. Because the matter proceeds only on the basis of the test report of the sample from the laboratory. Generally, in the absence of the investigation report, the trial of the case cannot be started. The solution to this problem is possible due to the arrangement of sample testing in the laboratory at the divisional level.
How did the work increase in the lab
According to the information, there are forensic labs in Jaipur and Jodhpur in the state. In all the NDPS Act cases in the state, the samples of narcotics are tested at these two laboratories only. In the year 2018, 1878 cases of NDPS Act were registered across the state. Whereas last year this number increased to close to three thousand, which this year may reach close to four thousand. Obviously, if the cases were doubled, the samples were also doubled. With this, the work of sample testing on the laboratory also doubled. Due to this, there is a delay of several weeks in reaching the investigation report in the districts.

According to law experts, in the cases of NDPS Act, the trial can start only after the investigation report of the seized narcotics from the laboratory is received. In a case, if the accused gives an application to start the trial even before the investigation report, then the matter is different.

The charge is imposed on the accused only after the investigation report. Due to this there is a possibility of delay in the cases.
